Waiver and Release Agreement

IMPORTANT: READ EACH SECTION
I acknowledge and agree that if I participate in any recreational or other activities, including but not limited to, parasailing, jet skiing, waterskiing, boating, diving, snorkeling, swimming or any other water activities, helicopter rides, hot air balloons, riding horses or any other animal, feeding or swimming with sharks or other wild animals, shooting firearms, off-road riding or driving, biking, operating or riding on an all terrain vehicle, zip lining, spa treatments, and consumption of alcoholic beverages, I do so at my own risk, and I assume all the risks and liabilities that may be associated with such activities. I understand that any or all of these activities may require substantial physical exertion, and may take place at high altitudes, in remote locations with limited or no access to medical facilities, or in areas frequented by wild animals and insects. I understand that neither Syngenta, One 10 LLC, nor any of their affiliates, officers, directors, agents, employees, clients and representatives (hereinafter referred to collectively as the "Releasees") are in any way involved in the management or control of the companies or their employees who provide or operate said activities, and that the Releasees sole involvement is arranging the activities.
I do hereby on behalf of myself, and my spouse, domestic partner, significant other, heirs, next of kin, legal representatives, successors and assigns (and in the event of pregnancy my unborn child and the father of my unborn child), forever release, indemnify and discharge the Releasees from and against any and all liability and claims, and agree that the Releasees will have no responsibility for and will not be liable, for any injury, damage, loss, claim or expense arising out of or related to my involvement with or participation in any activity even if caused by the negligence of the Releasees. It is not my intent to release the Releasees from liability arising from their gross negligence or intentional torts. I further agree not to bring any claim or cause of action against the Releasees for any injury, damage, loss or expense that relates in any way to my involvement with or participation in any activities. I agree that the laws of the State of Minnesota and the United States will govern this agreement and that any dispute arising out of or in connection with this agreement must be determined by a court in Hennepin County, Minnesota, USA. I understand that this agreement does not replace or modify any other release between me and any other party.
I UNDERSTAND THAT THIS IS A LEGAL AGREEMENT. I FURTHER REPRESENT AND WARRANT THAT I HAVE READ AND UNDERSTAND THE INFORMATION IN THIS AGREEMENT AND BY VOLUNTARILY CHECKING THE 'I AGREE' BOX ON THE REGISTRATION WEBSITE, TO RELEASE THE RELEASEES FROM ANY AND ALL LIABILITY AS OUTLINED ABOVE.
